POLICIES, TERMS & CONDITIONS - 2019

Important information pertaining to Journi (Pty) Ltd.

1. INTRODUCTION

These terms and conditions (“Terms”) apply to all orders placed with Journi (Pty) Ltd ("Journi"), whether online, telephonically, via email, in person, or in any other way. 

By placing your order with Journi, you agree that these Terms are binding on you without qualification or exception. You agree to be bound by and shall be regarded to have accepted to abide by these Terms, and you acknowledge to have read and understood them. If you do not agree to any of the Terms, you should not place an order with Journi.
2. PRODUCTS

All product items are handmade. As such, sizes and colours (as per website product images) may vary slightly on delivery - based on availability of materials and other factors. 
3. PAYMENT

100% payment is required on placement of the order. As items are handmade - the majority on order - the manufacture of products will only commence once payment has been paid. Once the payment is received, your order is irrevocable. Where we can accommodate any changes to your order, such changes may come at an additional expense.
4. LEAD TIMES

Lead times for orders placed depend on the size of the order. As items are typically handmade to order, typical lead time is 5-7 working days. Once payment has been received, the estimated lead time will be confirmed with the purchaser telephonically or via email.

Journi will use its best endeavours to ensure that the order is completed within the estimated lead time. However, lead times are subject to variation and are dependent on various external factors, such as the availability of materials.

5. DELIVERY

We aim to deliver products within 7 working days of order placement. Once a customer's order is ready, they will be notified via email as to details of the appointed courier responsible for delivery, as well as provided a tracking number to trace the order once it leaves our warehouse. Transportation costs are currently included in the product cost. Should you require delivery outside of the Republic of South Africa, please contact us for a formal quotation.

Should the delivery address or purchaser not be ready to receive the product on the given date, the purchaser shall be liable for extra costs incurred to re-schedule the delivery if applicable.

Journi cannot be held liable for any damages incurred during delivery. 

6. RETURNS AND EXCHANGES

As the products are manufactured according to your order, Journi cannot accept any returns or exchanges of functioning products. Only defective products may be exchanged.

Damage caused as a result of:
• faults resulting from normal wear and tear;
• negligence, abuse or incorrect use of the product;
• failing to care for the product adequately;
• and alterations to the product
shall not be regarded as defects and will not entitle you to exchange of the product.

A product will also not be considered to be defective where the product has been accurately described on the website and is generally fit for purpose, but does not suit you.

In order to return a defective product, please email us images and information about the relevant product. We shall then assess the product and should we determine the product to be defective, we will arrange for the defective product to be collected from you and we will replace the product. Please note that return courier services may come at a cost to the client.

As items are "limited edition" in nature - it may not always be possible to exchange the item for the same version or design. If exchange of the defective product is not possible, Journi will offer an alternative product at the same price, credit your account, or refund you (at your option) for the purchase price of the defective product. Credits and refunds are generally processed within 7 (seven) working days of logging the return. Replacements may take longer, depending on the availability of parts and/or replacements.

Should you wish to return a defective product, please ensure that the defective product is re-packaged in suitable packaging to prevent damage to the product in transit. Our selected courier reserves the right to refuse to collect a defective product if that product is not properly packaged for transit.

7. GUARANTEES

The products have a 30 day guarantee from date of delivery. Any products that are claimed to be defective must be exchanged within this 30 day period.
8. PRIVACY POLICY
All customer information submitted to Journi (Pty) Ltd via the email subscription, or purchasing process (as defined as "the ordering and/or ensuing purchase of product/s via the Journi (Pty) Ltd website") remains non-disclosable to third-parties. Customer information may by utilised in Journi's marketing efforts from the date of acquisition and henceforth. Information submitted via third parties - such as payment providers - adheres to the privacy policies of such parties and Journi (Pty) Ltd cannot be held liable for the use of information submitted to such parties. 

9. INDEMNITY

Journi, its contractors, employees and agents shall not be liable for any injury (including death), claim, loss, liability, damage, cost or expense of whatsoever nature suffered or incurred by any person who places an order from Journi, whether such injury or damage arose from negligence or otherwise. A person placing an order indemnifies Journi from any claim, loss, liability, cost or expense which may arise from such person’s order and/or use of the product delivered in terms of the order.

10. INTELLECTUAL PROPERTY

The logo, name and copyright employed in the creation of the Journi.co.za website, social media forums, and products, are considered intellectual property of Journi. Third-parties have no right to use or reproduce any such intellectual property, without written consent of Journi.

11. LIMITATION OF LIABILITY

To the extent permitted by law, Journi shall not be liable for any direct, indirect, incidental, or consequential damages including, without limitation, lost revenues, costs of replacement goods, loss or damage to data arising out of any order placed or in connection with the delivery of the products, or the products themselves, whether based on warranty, contract, delict, or any other legal basis or from any other cause even if Journi has been advised of the possibility of such damages.

12. LAW

The entire provisions of these Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Furthermore, the parties to these Terms hereby irrevocably and unconditionally consent to the non-exclusive jurisdiction of the courts of the Republic of South Africa in regard to all matters arising from these Terms.
